May a sinner (over a particular transgression) be counted toward the minyan?

Synopsis

The Mechaber rules that a transgressor who has not been excommunicated still counts toward the minyan. The Mishnah Berurah adds that one who sins out of appetite counts, but one who sins out of defiance (to anger God), or a heretic, or one who desecrates Shabbat publicly, does not count.
